InvertMate Terms of Use

Welcome to InvertMate! By using our app, you agree to these terms. Please read them carefully. If you don’t agree, please don’t use the app.

1. Acceptance of Terms

By downloading, installing, or using InvertMate (“the App”), you agree to be bound by these Terms of Use (“Terms”). These Terms constitute a legally binding agreement between you and the InvertMate team (“we,” “us,” or “our”).

If you do not agree to these Terms, you must not use the App.

2. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by:

  • Updating the “Last Updated” date at the top of these Terms
  • Posting the updated Terms in the App
  • Providing an in-app notification for significant changes

Your continued use of InvertMate after changes are posted constitutes your acceptance of the updated Terms.

3. Description of Service

InvertMate is a mobile application designed to help users manage and track the care of their invertebrate pets. The App provides features including but not limited to:

  • Pet profiles and record keeping
  • Feeding and watering schedules and reminders
  • Molt and growth tracking
  • Photo storage and management
  • Species care information library
  • Data export and backup functionality
  • Premium features through in-app purchases

4. User Accounts and Eligibility

InvertMate does not require an account to use. However, you must:

  • Be at least 13 years of age to use the App
  • Have the legal capacity to enter into these Terms
  • If you are under 18, have permission from a parent or guardian
  • Comply with all applicable laws in your jurisdiction

5. Premium Features and In-App Purchases

5.1 Free and Premium Content

InvertMate offers both free features and premium features available through in-app purchase. Premium features may include:

  • Unlimited invertebrate profiles (free version may have limits)
  • Advanced tracking and analytics
  • Enhanced photo storage
  • Ad-free experience
  • Priority customer support
  • Additional species care information
  • Exclusive features and early access to updates

5.2 Pricing and Payment

Premium features are available through:

  • One-time purchase: Lifetime access to premium features with a single payment
  • Subscription: Recurring access to premium features billed at regular intervals

All prices are displayed in the App Store in your local currency. Prices are subject to change at any time, but changes will not affect active subscriptions until renewal.

5.3 Subscription Terms

If you purchase a subscription:

  • Payment will be charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions in your App Store account settings
  • No refund will be provided for the unused portion of any subscription period

5.4 Free Trials

We may offer free trial periods for premium subscriptions. If you start a free trial:

  • You will have access to premium features for the trial duration
  • You can cancel anytime during the trial without being charged
  • If you don’t cancel before the trial ends, you will be automatically charged and your subscription will begin
  • You may only use one free trial per account

5.5 Refund Policy

All purchases are processed through Apple’s App Store and are subject to Apple’s refund policies. We cannot directly issue refunds. To request a refund:

Refund approval is at Apple’s sole discretion.

5.6 Promotional Offers

We may occasionally offer promotional pricing or special offers. These promotions:

  • Are subject to specific terms and conditions
  • May be limited in duration or availability
  • Cannot be combined with other offers unless explicitly stated
  • Are not transferable or redeemable for cash

6. User Content and Data

6.1 Your Data

You retain all rights to the content you create in InvertMate, including:

  • Pet profiles and information
  • Photos and images
  • Notes and logs
  • Any other user-generated content

6.2 Data Storage

All your data is stored locally on your device. We do not store, collect, or have access to your personal data. You are responsible for:

  • Maintaining backups of your data
  • Ensuring your device is secure
  • Managing your iCloud sync settings (if enabled)

6.3 Data Loss

We are not responsible for any data loss that may occur due to:

  • Device failure or malfunction
  • Accidental deletion
  • App uninstallation
  • iOS updates or changes
  • Any other circumstance beyond our control

We strongly recommend regularly exporting and backing up your data.

7. Acceptable Use

You agree to use InvertMate only for lawful purposes. You must not:

  • Use the App in any way that violates applicable laws or regulations
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use the App to transmit malware, viruses, or harmful code
  • Interfere with or disrupt the App’s functionality
  • Use automated systems or bots to access the App
  • Attempt to gain unauthorized access to any part of the App
  • Share or distribute premium features without authorization

8. Intellectual Property Rights

InvertMate and all its contents, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9. Species Information Disclaimer

Important: The species care information provided in InvertMate is for educational and reference purposes only. It should not be considered professional veterinary advice.

You acknowledge and agree that:

  • Care information is based on general guidelines and may not be suitable for all individual animals
  • You are solely responsible for the health and wellbeing of your invertebrates
  • You should consult qualified professionals for specific care advice
  • We are not liable for any harm to your invertebrates resulting from following the information provided
  • Care requirements may vary based on individual circumstances

10. Disclaimers and Limitation of Liability

10.1 “As Is” Basis

InvertMate is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of information

10.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or other intangible losses
  • Damages resulting from your use or inability to use the App
  • Damages resulting from any content or conduct of third parties
  • Harm to your invertebrates based on information provided in the App

Our total liability to you for all claims arising from or related to the App shall not exceed the amount you paid us in the 12 months preceding the claim.

10.3 Service Availability

We do not guarantee that:

  • The App will be available at all times or uninterrupted
  • The App will be free from errors, bugs, or technical issues
  • Defects will be corrected
  • The App will meet your specific requirements

11. Third-Party Services

InvertMate may integrate with third-party services including:

  • Apple App Store and StoreKit for purchases
  • iCloud for optional data syncing

Your use of these third-party services is governed by their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

12. Termination

12.1 By You

You may stop using InvertMate at any time by:

  • Deleting the App from your device
  • Canceling any active subscriptions

12.2 By Us

We reserve the right to suspend or terminate your access to InvertMate at any time if:

  • You violate these Terms
  • We suspect fraudulent or illegal activity
  • We discontinue the App

12.3 Effect of Termination

Upon termination:

  • Your right to use the App will immediately cease
  • You will lose access to premium features
  • We are not obligated to provide refunds for unused subscription periods
  • All provisions that should survive termination will remain in effect

13. Indemnification

You agree to indemnify, defend, and hold harmless InvertMate, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your violation of any applicable laws or regulations

14. Geographic Restrictions

InvertMate is available worldwide through the Apple App Store. However:

  • You are responsible for complying with local laws regarding invertebrate ownership
  • Some features may not be available in all regions
  • Pricing may vary by region

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction of residence, without regard to conflict of law principles.

15.2 Dispute Resolution

If you have a dispute with us, please contact us first to attempt to resolve it informally. We will make good faith efforts to resolve any disputes amicably.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and InvertMate regarding the use of the App and supersede all prior agreements and understandings.
